Feminicide is a term in Mexican Law that applies to women being murder for “gender motives”, extreme cruelty, and having a direct relationship, extreme cruelty, with the killer, if there is sexual assault involved, and other Law explicit stipulations, the fact of the matter is that not every woman´s murder is legally a feminicide, there´s a Legal profile to be filed to be considered so.
The sentence of 23 years in prison that a judge handed down to the feminicide of a young woman in Mexicali, through an abbreviated procedure, and that surprised Mexicali society for being, perhaps for public opinion, a very short prison sentence, for the magnitude of a crime that had characteristics of great coldness and a prison sentence that could be reduced to just over half, according to lawyers who gave their opinion on the subject.
The abbreviated procedure, which is an agreement reached by the parties before reaching an oral trial, must have the participation of both parties, in this case it is Genebit’s relatives who should have agreed to this resource and within of the secrecy of the case, the family has not declared and, apparently, will not declare anything regarding this sentence.
While cases like that of Melesio Jimenez Pinacho, a feminicide from Tijuana who killed his romantic partner and his stepdaughter with machetes and received a 75-year prison sentence after being found guilty of a crime that has no parallel, due to the cruelty and manner in which, out of nowhere, this person was furious to attack his partner and stepdaughter.
Another example is that of Héctor Marcelino “N”, accused of attempted feminicide, in February 2021 in Valle del Puebla, who could face 25 to 45 years in prison, according to a Reform approved January-February, in the Chamber of Deputies of the LXV Legislature, a greater penalty for attempted feminicide than Genebit’s own feminicide.
In the case of Genebit, the feminicide perpetrator, who had a stormy sentimental relationship with her, suffocated her to death, dressed her in his clothes and put her in the trunk of his car, a frightening display of cold blood, in an incidental turn of events he was caught at his garage door when he was about to drive away and dispose of the body, but everything was left behind by the abbreviated procedure.
